ESPAI PROGRES 78, S.L.U is the RESPONSIBLE for processing the USER’s personal data and informs you that this data will be processed following the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD).
Why do we process your personal data?
To maintain a commercial relationship with the user. The operations planned to carry out the treatment are:
Sending of advertising commercial communications by email, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that enable commercial communications. These communications will be made by the RESPONSIBLE and will be related to their products and services, or those of their collaborators or suppliers, with whom they have reached a promotion agreement. In this case, third parties will never have access to personal data.
Conduct market research and statistical analysis.
Process orders, requests, respond to inquiries, or any type of request made by the USER through any of the contact forms available on the RESPONSIBLE’s website.

With the consent of the USER: sending commercial communications and the newsletter.
On legitimate interest of the RESPONSIBLE: conducting market research, statistical analysis, etc. and processing orders, requests, etc. at the request of the USER.
How long will we keep your personal data?
They will be kept for no longer than necessary to fulfill the purpose of the treatment or as long as legal prescriptions dictate their custody, and when it is no longer necessary, they will be deleted with adequate security measures to ensure the anonymization of the data or their total destruction.
Who do we provide your personal data to?
No communication of personal data to third parties is foreseen except, if necessary for the development and execution of the treatment purposes, to our service providers related to communications, with whom the RESPONSIBLE has confidentiality and treatment manager contracts required by current privacy regulations.
By contracting our services, you are authorizing us to transfer your personal data to the company FLEXMYROOM INSURETECH, S.L., located in Benidorm (03503 – Alicante), Calle Gerona, 13, Local CA 18, and with CIF number B42687616, solely for the purpose of protecting your reservation by enjoying the insurance services and products offered. Only the strictly necessary data for the activation of the insurance (name and surname, identity number, postal address, and contact details) will be transferred in our common interest. This entity will delete your personal data when the service has ended and the legally established deadlines have been met. You can exercise your rights of access, rectification, deletion, limitation of processing, data portability, and objection to processing and not be subject to automated decisions at the email address datos@flexmyroom.com.

The rights that assist the USER are:
- Right to withdraw consent at any time.
- Right of access, rectification, portability, and deletion of your data, and to limit or oppose their processing.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER
USERS, by checking the corresponding boxes and entering data in the fields marked with an asterisk (*) on the contact form, expressly and freely and unequivocally accept that their data is necessary for their request to be attended by the provider, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the RESPONSIBLE is truthful and is responsible for communicating any changes to it.
The RESPONSIBLE informs that all data requested through the website is mandatory, as it is necessary for the provision of an optimal service to the USER. In the event that not all data is provided, it is not guaranteed that the information and services provided will be completely tailored to your needs.
3. SECURITY MEASURES
In compliance with the provisions of current regulations on personal data protection, the RESPONSIBLE is complying with all the provisions of the GDPR and LOPDGDD for the processing of personal data under its responsibility, and manifestly with the principles described in article 5 of the GDPR, under which they are treated in a lawful, fair, and transparent manner in relation to the data subject and appropriate, relevant, and limited to what is necessary in relation to the purposes for which they are processed.

E-commerce (accommodation reservations). General conditions of contracting
GENERAL TERMS OF CONTRACTING
This contractual document will regulate the contracting of products and services through the website [[Web]], owned by ESPAI PROGRES 78, S.L.U, hereinafter ESPAI PROGRES 78, S.L.U
The acceptance of this document implies that the USER:
- Has read, understands, and comprehends what is stated here.
- Is a person with sufficient capacity to contract.
- Assumes all obligations set forth herein.
These conditions will have an indefinite validity period and will be applicable to all contracts made through the website of ESPAI PROGRES 78, S.L.U
ESPAI PROGRES 78, S.L.U informs that the company is responsible and knows the current legislation of the countries to which it offers its services and reserves the right to unilaterally modify the conditions, without this affecting the goods or promotions that were previously contracted before the modification.
Identity of the contracting parties
On the one hand, the provider of the services contracted by the USER is ESPAI PROGRES 78, S.L.U, with registered office at CARRER PROGRES 78, 08904 L’HOSPITALET DE LLOBREGAT (BARCELONA), NIF B66971409 and with customer/USER service telephone 965216918.
And on the other hand, the USER, registered on the website through a username and password, for which they are fully responsible for use and custody, and are responsible for the accuracy of the personal data provided to ESPAI PROGRES 78, S.L.U
Object of the contract
The purpose of this contract is to regulate the contractual relationship between ESPAI PROGRES 78, S.L.U and the USER at the time the USER accepts, during the online contracting process, the rental of real estate for temporary accommodation.
The contractual relationship for accommodation reservation involves the rental of the chosen property for a limited time, in exchange for a specific price publicly displayed on the website. Additional services must be contracted at the time of booking.
Contracting process
The USER, in order to access the services or products offered by ESPAI PROGRES 78, S.L.U, must register through the website by creating a user account. Therefore, the USER must provide personal data freely and voluntarily, which will be processed in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD), detailed in the Legal Notice and Privacy Policy of this website.
The USER will select a username and password, committing to use them diligently and not make them available to third parties, as well as to inform ESPAI PROGRES 78, S.L.U of any loss or theft of them or possible unauthorized access, so that immediate blocking can take place.
Once the user account has been created, it is informed that in accordance with the requirements of article 27 of Law 34/2002, of Services of the Information Society and Electronic Commerce (LSSICE), the contracting process will follow the following steps:

1. GENERAL CONTRACTING CLAUSES
Unless otherwise stipulated in writing, placing an order with ESPAI PROGRES 78, S.L.U implies the USER’s acceptance of these legal conditions. No stipulation made by the USER may differ from those of ESPAI PROGRES 78, S.L.U unless expressly accepted in advance and in writing by ESPAI PROGRES 78, S.L.U
2. BOOKING PROCESS AND PAYMENT
Our automatic availability and price calculation system will allow you to choose the apartment or house you are interested in and immediately make the online payment of 40% of the rental price or, alternatively, you can make a bank transfer within a maximum period of 48 hours. If this transfer cannot be made within that period, your reservation will be automatically canceled. The expenses incurred by this method of payment will be borne by the USER.
Reservation confirmation: Once the 40% payment has been made, the reservation will be confirmed instantly, and you will immediately receive an email with all the details (apartment address, contact person details, dates, etc.)
Security in online payment: ESPAI PROGRES 78, S.L.U is committed to protecting USER data to the maximum and cannot access or view the credit card number you enter in the form at any time; this information is encrypted and will be visible exclusively to the banking entity.
Deposits
ESPAI PROGRES 78, S.L.U has three types of deposits ranging from 200 € to 500 €. In the case of young tenants, they must pay 50 € per person with a minimum of 250 €.
The deposit payment is always in cash because upon leaving the accommodation, after an inspection, it will be returned in cash as well. In case of damage to the accommodation, it will be deducted from this deposit.
Check-ins and check-outs
Check-ins and check-outs for our accommodations are on Saturdays.
Check-ins: Key pick-up hours are from 5:00 PM to 8:00 PM at our offices at CARRER PROGRES 78, 08904 L’HOSPITALET DE LLOBREGAT (BARCELONA).
Your accommodation will not be available before 5:00 PM. If you arrive earlier, please call us to store your luggage at the agency.
For arrivals from 8:30 PM to midnight, an additional cost of 70.00 € will apply.
Arrivals after midnight will not be accepted, and you will not be able to enter the accommodation until 8:00 AM the following morning.
Upon arrival at our agency, and in accordance with current legislation, you must hand over the booking sheet, and we will proceed to identify all occupants of the accommodation.
Next, the reservation holder will sign a rental agreement and pay the remaining 60% of the rent plus 20.00 € for management fees and the Tourist tax of 0.50 € per day per person over 16 years old, with a maximum of 7 days. (Law 5/2012 of 20/3/12. D.O.G.C. no. 6094 of 23/03/12) and the deposit. You can pay by credit card or cash. The deposit will always be in cash.
The accommodation is delivered clean and with all kitchen utensils and cookware. Bath towels and bed sheets per person are included in the rental price.
Check-outs: Check-out times for accommodations are from 8:00 AM to 10:00 AM. A representative from the agency will arrive at your accommodation at the agreed time to check the condition of the apartment, collect the keys, and return your deposit.
At the agreed time of checkout, tenants must be ready with their bags packed, the apartment cleaned and tidy. You must return the accommodation in the same condition as you found it upon arrival.
Additional services
If you are interested in hiring our extra services, you must do so at the time of booking:
Cleaning: You can hire our final cleaning service. For 1-bedroom accommodations 50.00 €, for 2-bedroom accommodations 60.00 €, for 3-bedroom accommodations 70.00 €, for 4-bedroom accommodations 80.00 €, Private house (semi-detached) 110.00 €, and Individual villa 160.00 €.
Crib: The rental cost of the crib is 60.00 €.
Baby chair: The rental cost of the baby chair is 45.00 €. Extra bed: The rental cost of an extra bed is 70.00 € There are accommodations where pets are allowed, if you have a pet, you must inform ESPAI PROGRES 78, S.L.U at the time of booking for authorization.
Customer responsibilities
Customers are required to comply with Community regulations. During the resting hours from 10:00 PM to 9:00 AM, the accommodation must not be used for party celebrations or noise. Under no circumstances is it allowed to occupy the accommodation with more people than the maximum capacity.
The use of electricity and water must be rational. When the air conditioning is on, remember to close doors and windows.
Hanging towels and clothes on balcony railings is prohibited.
The pool hours are set by each Community and generally run from 10:00 AM to 9:00 PM. It is prohibited to nail objects such as parasols, awnings, etc., in the lawn, as well as use inflatable mattresses inside the pool.
Children must always be accompanied by their parents and under their responsibility.
The contract holder is responsible for the correct behavior of all occupants. If there is improper behavior, ESPAI PROGRES 78, S.L.U reserves the right to remove occupants from the accommodation, with no further claims or compensation.
Neither ESPAI PROGRES 78, S.L.U nor the owner will be responsible for any direct or indirect damage that may be caused due to the misuse of the accommodation, including but not limited to: damage, losses from fires, theft, crime, accidents, or other types of damage.
3. CANCELLATIONS (RIGHT OF WITHDRAWAL)
ESPAI PROGRES 78, S.L.U will only accept reservation cancellations in writing via email:

If the reservation is canceled more than 30 days before the arrival date, ESPAI PROGRES 78, S.L.U will refund 50% of the reservation to the customer.
If the reservation is canceled after 30 days before the arrival date, the total amount of the reservation will not be refunded (100%).
4. CLAIMS
Our goal is for our customers to have an enjoyable stay.
If there is a breakdown in the facilities or electrical appliances during the rental period, you must notify ESPAI PROGRES 78, S.L.U immediately to resolve these incidents as soon as possible.
In the event of force majeure (damage caused by water, fire, etc.), ESPAI PROGRES 78, S.L.U will replace the reserved accommodation with one of the same characteristics. If there are no available accommodations, ESPAI PROGRES
